The federal government has
a new weapon in the failed war on drugs.
This time Washington is using federal banking laws and the tax code to suppress
the voters' will in 16 states and the District of Columbia.
Under federal statute, in states like Colorado and California -- where
medicinal marijuana is legal and well-regulated -- the federal government can
charge banks for money laundering or aiding drug trafficking if they accept
deposits from a marijuana dispensary. Frequently, state-sanctioned dispensaries
can't even use simple banking services like checking accounts. Additionally,
the IRS is seeking to use its power to shut down these legal businesses in the
name of tax evasion even though they are filing their taxes and behaving just
like any other business.
That's why I'm joining with fearless members of Congress Pete Stark, Dana
Rohrabacher, Barney Frank, and Ron Paul to stand up for these small businesses.
We just introduced three bills to combat these senseless attacks on legal
businesses.

These bills are an important first step toward restoring state governments'
ability to represent the will of the voters they serve, rather than the will of
the federal government to perpetuate the failed war on drugs.
Some politicians might be wary of bills that have the potential to make them
look "soft on drugs." But my colleagues should be more concerned with
following the will of their constituents. In states like California and
Colorado where medicinal marijuana is legal, the voters have spoken -- and the
federal government should not use our banking laws and tax code to suppress
their voice.
